    The position requires a high level of business orientation with focus on problem solving and supporting projects, while upholding strong ethics and integrity across the organization. The role reports to the North America General Counsel and works with all North American subsidiaries.

    In your primary role, you will be responsible for the following:

    Provide clear contractual analysis and advice to the project team on matters concerning contractual obligations including but not limited to extension of time, change orders, liquidated damages, termination of contract, etc.
    Identifying, evaluating, contractual outgoing and/or incoming claims and support the project team to enforce/defend claims (including preparation of and participation in negotiations).
    Developing and implementing claim strategies as well as maintaining a systematic management of incoming and outgoing claims.
    Documenting all claim relevant events and contract deviations during execution in a structured way by using the applicable tools.
    Drafting and negotiating change orders and other contractual documents to support the project execution team.
    Analysis and commenting on tenders, contracts, and contract-related documents to identify and inform business about contractual risks, opportunities, and mitigation measures.
    Ensure compliance of internal guidelines/directives and approval process related to bidding activities.
    Participating in contract negotiations, formulating/implementing negotiation strategy, documenting negotiation results and preparing adjustments to contract documents, as needed.
    Collecting, preparing, managing relevant documents (including drafting of letters) and evidence in accordance with contractual deadlines and requirements.
    Promoting contract management culture in company at various levels through training, workshops, etc..
    Ability to manage numerous matters simultaneously and competing priorities and to work within a matrix set up.
    Additionally, your role would also from time to time include the following:

    Managing expectations of multiple business stakeholders at all levels within the organization.
    Training: You will be required to learn and share what you have learned by way of trainings to the legal team and business on various topics.

    Profil

    Education:

    • Bachelor's Degree in Business or Engineering focus, required.

    • Advanced degree in Business or Law not required but considered beneficial.

    Qualifications & Traits:


    • Five (5) plus years of demonstrated progressive responsibility and experience in contract management; of which at least three (3) years include contract management / transactional experience in a complex engineering project related field.

    • Advanced communication and legal writing skills (English), a problem-solving and solution-oriented approach and a dedicated attitude.

    • Driven by integrity, ownership culture and reliability.

    • Demonstrated success of handling complex high dollar contracts specific to the purchase of complex, manufactured goods, installation and maintenance services and long term parts/services.

    • Demonstrated knowledge of legal business practices and concerns related to contract and claim management, and the contractual and commercial aspects of complex, manufactured goods, installation and maintenance services and long term parts/services.

    • Demonstrated abilities to formulate logical approaches and make effective recommendations to address complex issues.

    • Demonstrated strong negotiations skills with the ability to effectively lead or support a matrixed negotiating team consisting of Legal, Engineering, Procurement, and Project personnel.

    • Self-driven and resourceful to achieve goals independently and work well in groups.

    • Flexibility to adjust to changing requirements, schedules and priorities.

    • The ability to socialize ideas, make recommendations and generate team consensus to move forward; this also includes meeting facilitation skills.

    • Excellent verbal communication and writing skills with demonstrated ability to develop and communicate clearly and concisely with all levels of stakeholders.

    • Communicate consistent contractual positions and persuade other parties to accept the fairness of Fives' position.
